Key Responsibilities

  • Draft, review, negotiate and administer commercial contracts, including:
    • Power purchase and sale agreements (PPAs) for the regulated (ACR) and free (ACL) markets including Balcão Brasileiro de Comercialização de Energia (BBCE) contratos padrão de compra e venda de energia elétrica
    • CCEE adhesion contracts and trading agreements
    • Non-disclosure agreements and confidentiality agreements
    • Other power marketing and trading agreements as required
  • Coordinate the review and approval process of agreements amongst Legal, Credit and Front Office teams, ensuring proper execution and compliance with Brazilian regulatory requirements
  • Manage contract entry into the Contract Management system, ensuring accurate data capture and regulatory compliance reporting
  • Participate in the configuration and deployment of trade confirmation templates within our contract lifecycle management system, adapted for Brazilian power market requirements and CCEE procedures
  • Support the development and implementation of Contract Administration team procedures and standards to ensure adherence with:
    • ANEEL/CCEE regulations and guidelines
    • Industry best practices in the Brazilian power sector
  • Strictly adhere to and comply with Trafigura's policies and codes, ensuring all activities align with corporate governance standards and Brazilian legal requirements

Knowledge Skills And Abilities

  • Required: Bachelor's degree in Law (Bacharelado em Direito) from a recognised Brazilian university and admission to the Brazilian Bar Association (OAB - Ordem dos Advogados do Brasil)
  • Fluency in English and Portuguese (written and spoken) are a MUST
  • Minimum of 5 years' experience in power/electricity contract administration within an energy trading company or utility
  • Concrete understanding of energy trading activities in the Brazilian power sector, including transmission, distribution, and energy storage contracting
  • Solid understanding and working knowledge of:
    • Power purchase and sale agreements (PPAs) in the Brazilian market including Balcão Brasileiro de Comercialização de Energia (BBCE) contratos padrão de compra e venda de energia elétrica
    • CCEE (Câmara de Comercialização de Energia Elétrica) regulations and procedures
    • Financial derivatives and hedging instruments for power trading
    • Grid connection agreements and transmission contracts with ONS (Operador Nacional do Sistema Elétrico)
    • NDAs and related power sector agreements
  • Good understanding of Brazilian regulatory framework including ANEEL regulations, free energy market (ACL - Ambiente de Contratação Livre), and/or renewable energy certificates and environmental credits is an asset
  • Knowledge in below is advantageous:
    • Financial derivatives and hedging agreements for power trading
    • Transmission and distribution connection agreements
    • Energy storage and backup power agreements
  • Additional beneficial qualifications:
    • Postgraduate specialisation (Pós-graduação) in Energy Law or related field
    • Experience with distributed generation regulations and net metering frameworks
