We are currently seeking an experienced individual to join this team in the role of Head of Regulatory Compliance IWPB and RC Stewardship India.

Role Purpose

The Risk & Compliance function is a Second line of defence (LOD) function, responsible for reviewing and challenging the activities of the Groups businesses (also referred to as the First LOD) to ensure that they effectively manage as Risk Owners the risks inherent in or arising from the conduct of their activities and for which they are responsible. The Second LOD consists of 'Risk Stewards' who are independent of the commercial risk-taking activities undertaken by the First LOD. The Risk & Compliance function is a Risk Steward for a number of risks in accordance with HSBC Groups risk framework.

The Head of Regulatory Compliance IWPB and RC Stewardship for India INM is the senior accountable executive responsible for ensuring that HSBCs operations in INM are effective in identifying, managing and mitigating Regulatory Compliance risks and ensure timely advice is provided to the business. The role is a key management role with a broad remit and responsibilities including:

  • The effective oversight and advice on high-level Regulatory Compliance (RC) risk related matters relating to INM, the oversight of RC risk-related stewardship across the INM Regulatory Compliance function and the assessment of current and forward-looking aspects of RC risk exposure in partnership with the Chief Compliance Officer (CCO) India INM and the business facing Regulatory Compliance Officers.
  • Working closely with the Chief Compliance Officer, establish strategic RC standards and policies and support the business facing Compliance Officers in setting risk appetite limits in relation to the RC risks (specifically, breach of regulatory duty to clients and other counterparties, inappropriate market conduct, breach of other regulatory requirements) as relevant to the business facing Regulatory Compliance Officers areas of responsibility.
  • Primarily to support the Head of Regulatory Compliance, to maintain an effective control framework and to ensure compliance with all relevant external laws & regulations, internal codes and policies and good market practices with primary focus on IWPB area. Lead the team to work with relevant contacts in WPB to implement Banks strategy, policy and standards as well as controls and systems to manage underlying regulatory compliance risks.
  • Articulate the Regulatory Compliance risks relevant for IWPB in India INM.
  • Oversee the implementation and operational effectiveness of those standards and policies by business facing Compliance Officers across INM and ensure that INM RC risks are managed in a commercially sensitive, practical and cost effective manner.
  • Lead the Compliance-wide Risk Strategy Oversight capability supporting stewardship of RC risks associated with HSBC India, including Compliance risk stewardship oversight activities and the coordination of Compliance risk framework transformation/enhancement initiatives.

Accountabilities for Business, Customers and Stakeholders

  • Oversee the critical Compliance policies and systems that impact INM and ensure that the Groups exposure to Regulatory Compliance risks is managed in a commercially sensitive, practical and cost effective manner.
  • Provide advice and support on Regulatory Compliance risks to senior management, Compliance and other colleagues.
  • Membership of relevant regulatory compliance risk related executive committees/forums/governance meetings.
  • Provide subject matter expertise, advice and effective challenge to Business Service Owners and Process Owners on the association of risks and controls to critical / material business services, including supporting processes.

Customers / Stakeholders

  • Reporting to Head of Chief Compliance Officer, India Regulatory Compliance INM as relevant on Regulatory Compliance risks matters.
  • Ensure that senior management are appropriately advised of all material regulatory compliance related matters relating to IWPB INM including regulatory developments and emerging risks environment.
  • Manage and foster a strong relationship with all relevant regulators in relation to the activities of INM and ensure timely disclosure of relevant information, in relation to Regulatory Compliance related matters.
  • Ensure that positive relationships are maintained with other external stakeholders relevant to the regulatory compliance agenda.

Leadership & Teamwork

  • Provide leadership to and develop the Risk & Compliance Function for INM liaising closely with functional reports and (where relevant) with local line managers.
  • Maintain and develop positive and professional working relationships with senior business managers and Compliance colleagues at the Regional level and those in other Regions and Businesses.
  • Create an environment for the delivery of consistent performance measurement, training, career management and succession planning across the INM Risk & Compliance capability.
  • Establish a strategy for the sharing of Regulatory Compliance risks related compliance knowledge and best practice across INM and the wider Risk & Compliance Function and Group.
  • Provide leadership to and develop the Risk & Compliance Function for INM liaising closely with functional reports and (where relevant) with local line managers.

Knowledge & Experience / Qualifications

  • Significant experience as a regulator, or a senior compliance manager across all areas of Regulatory Compliance risk within a global firm, in the financial services industry.
  • Detailed and extensive knowledge of the HSBC Group structure, its business and personnel, and HSBCs corporate culture.
  • Thorough understanding of IWPB business with practical knowledge of broad range of IWPB products and services, in particular for Retail Banking business including risk stewardship
  • Significant leadership experience and an experienced strategic thinker.
  • Excellent communication and inter-personal skills, with experience of dealing with executives at all levels.
  • Ability to develop practical, cost effective solutions to complex issues.
  • A legal or formal accountancy qualification or professional background in a relevant risk or audit discipline.
